Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and Jensen Enterprises LLC ("Company," "we," "us," "our"), the operator of MechTie at mechtie.com. By creating an account or using the platform you agree to be bound by these Terms and our Privacy Policy.

If you are using MechTie on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

You must be at least 18 years old to use MechTie. By creating an account you represent that you meet this requirement. Accounts created on behalf of minors will be terminated.

You agree to provide accurate, current, and complete information when creating your account and to keep it up to date. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.

You may not create more than one personal Specialist account. Team Manager accounts represent organizations and may be shared among authorized administrators within that organization.

All MechTie accounts — Specialist, Team Manager, and Enterprise — are currently provided free of charge. We reserve the right to introduce paid plans or limitations on free accounts in the future with at least 30 days advance notice to active users.

You are responsible for the accuracy of your profile, including all credentials, certifications, and availability information. Posting false or misleading credential information is a serious violation of these Terms and may result in immediate account termination.

We may introduce paid subscription plans in the future. If we do, the following terms will apply:

• Subscriptions will renew automatically on the same date each billing period.
• You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period — no partial-period refunds.
• We will provide at least 30 days advance notice before implementing or changing subscription pricing.
• Failed payments may result in suspension of paid features until payment is resolved.

You agree not to:

• Post false, misleading, or fraudulent credential or employment information
• Impersonate another person or entity
• Use the platform to harass, threaten, or discriminate against other users
• Scrape, crawl, or otherwise extract data from MechTie by automated means
• Attempt to gain unauthorized access to any part of the platform or its infrastructure
• Upload malicious files or content designed to harm the platform or other users
• Use JobOps Intelligence to analyze documents you do not have the right to share
• Abuse the AI assistant (Buzz) by submitting spam, harmful content, or attempts to manipulate its output
• Submit false or malicious feedback through the chatbot or feedback form
• Violate any applicable law or regulation

You retain ownership of any content you upload to MechTie, including profile information, photos, and job documents. By uploading content you grant Jensen Enterprises LLC a limited, non-exclusive license to store, display, and process that content solely for the purpose of operating the platform and providing services to you.

You represent that you have all rights necessary to upload any content you submit, and that doing so does not violate the rights of any third party.

MechTie uses artificial intelligence in several areas:

• Credential scanning: When you upload a certification image, AI extracts and categorizes the information automatically.
• Credential verification: Administrators use AI to screen uploaded credentials for accuracy and legitimacy.
• Buzz assistant: An AI chatbot that answers questions about MechTie, provides personalized guidance based on your profile data, and collects feedback.
• JobOps Intelligence: AI analyzes uploaded job documents to surface potential billing discrepancies, risks, and opportunities.

All AI-generated output is for informational purposes only and does not constitute legal, financial, or professional advice. You are solely responsible for verifying any AI findings. Jensen Enterprises LLC is not liable for any losses arising from reliance on AI-generated analysis.

When you interact with AI features, your inputs (including messages, images, and relevant profile data) are transmitted to a third-party AI provider for processing. See our Privacy Policy for details on how this data is handled.

By default your Gate Pass profile is publicly accessible to anyone with your profile URL or QR code. You acknowledge that information you include on your Gate Pass — name, certifications, availability status — will be visible to the public. Do not include information you wish to keep private.

If your profile is set to public, Enterprise account holders can discover your profile through the specialist search feature and save you to shortlists. Search results include your name, title, location, certifications, availability status, and hourly rate (if you have chosen to make your rate visible). You can control your profile visibility and rate visibility from your account settings.

When a Team Manager sends you an invitation via MechTie, your name and contact details are shared with that Team Manager for the purpose of onboarding you to their team. By accepting an invitation you consent to the Team Manager viewing your profile and managing your team membership within MechTie.

MechTie offers a referral program that allows you to invite other specialists to join the platform using a unique referral link. Referral badges (Pathfinder, Pioneer, Founding Member) are awarded based on the number of specialists who sign up through your link and are displayed on your public profile.

Founding Member status includes early access to new features as they become available. We reserve the right to modify or discontinue the referral program or its benefits at any time with reasonable notice.

We actively encourage feedback to improve MechTie. You can submit feedback through the Feedback tab on the site or through the Buzz chatbot. Feedback you submit may be stored, reviewed by our team, and used to inform product development. Feedback submissions are not confidential unless explicitly agreed in writing.

By using MechTie, you consent to receive transactional emails related to your account, including credential status updates, team invitations, referral milestone notifications, and certification expiry alerts. You can manage your notification preferences in your account settings.

The MechTie name, logo, platform design, and all original content created by Jensen Enterprises LLC are the property of Jensen Enterprises LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any MechTie-owned content without prior written permission.

MechTie is provided "as is" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not verify the accuracy of user-submitted credential information beyond what is technically possible — employers and team managers should conduct their own verification as appropriate.

To the maximum extent permitted by applicable law, Jensen Enterprises LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use MechTie, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or your use of the platform shall not exceed the greater of (a) the amounts you paid us in the 12 months preceding the claim, or (b) $100 USD.

You agree to indemnify, defend, and hold harmless Jensen Enterprises LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the platform, your content, or your violation of these Terms.

We may suspend or terminate your account at any time for violation of these Terms, or for any other reason with reasonable notice. You may close your account at any time from your account settings.

Upon termination, your right to use MechTie ceases immediately. Sections that by their nature should survive termination (including limitations of liability, disclaimers, and governing law) will survive.

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or your use of MechTie shall be resolved in the state or federal courts located in Georgia, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. We will notify active users by email at least 14 days before material changes take effect. Continued use of MechTie after changes take effect constitutes acceptance of the revised Terms.
